These Terms of Use (“Terms”) govern your access and use of the InChat mobile application (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms.
1.1. Age Restriction: The App is intended for individuals aged 13 and over. By using the App, you represent and warrant that you are at least 13 years old and possess the legal capacity to enter into this agreement. Users under the age of 18 must have parental consent to use the App.
1.2. Purpose: The App provides tools powered by Artificial Intelligence (AI) to assist you with communication and content creation. These tools include, but are not limited to:
– Text generation (emails, social media posts, creative writing formats)
– Information processing (summarization, translation, video analysis)
– Grammar and style correction
– Voice-to-text and text-to-speech functionality
– Subject-specific assistance (math solutions, code review)
1.3. Modification and Discontinuation: InChat reserves the right to modify or discontinue the App, or any portion thereof, at any time without prior notice.
2.1. Ownership and Responsibility: You are responsible for any content you generate or upload through the App (“User Content”). This includes, but is not limited to, text, images, and audio recordings.
2.2. Grant of License: By using the App, you grant InChat a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and distribute your User Content solely for the purpose of providing the App’s services. This includes storing User Content on InChat’s servers and displaying it within the App.
2.3. Representations and Warranties: You represent and warrant that you have all necessary rights, licenses, and permissions to grant the license set forth in Section 2.2 above. You further warrant that your User Content does not and will not infringe on the intellectual property rights or other rights of any third party.
2.4. Monitoring and Removal: InChat reserves the right, but does not have the obligation, to monitor User Content and remove any content that, in its sole discretion, is deemed to be offensive, unlawful, or in violation of these Terms.
2.5. Feedback and Suggestions: You acknowledge and agree that any suggestions, ideas, feedback, or other information you provide to InChat regarding the App (collectively, “Feedback”) shall be considered non-confidential and become the sole property of InChat. InChat shall have the right to use and exploit the Feedback for any purpose without any obligation to compensate you.
You agree not to use the App for any unlawful activity or to upload content that is:
– Defamatory, hateful, or discriminatory
– Infringes on any intellectual property right, including copyright, trademark, or patent
– Contains viruses or other malicious code
– Obscene, indecent, or otherwise inappropriate
-Used to impersonate another person or entity
– Used to spam or harass others
– Used to collect or store personal information about others without their consent
– Used for any illegal or unauthorized purpose
4.1. “As-Is” Provision: The App is provided “as is” and InChat makes no warranties, express or implied, regarding its performance or accuracy. The App is for entertainment purposes only and should not be relied upon for any critical tasks.
4.2. Interruptions and Errors: InChat does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
4.3. Limitation of Liability: To the extent permitted by applicable law, InChat shall not be liable for any damages arising from your use of the App, including, but not limited to, direct, indirect, incidental, consequential, or punitive damages.
The App may integrate with or link to third-party services. Your use of these services is subject to the terms and conditions of those third-party services. InChat is not responsible for the content or practices of any third-party service.
You agree to defend, indemnify, and hold harmless InChat, its officers, directors
employees, agents, licensors, and suppliers from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the App or your violation of these Terms.
InChat may terminate your access to the App for any reason, at any time, without notice. You may also terminate your use of the App at any time. Upon termination, your right to use the App will cease immediately. InChat may also, in its sole discretion, and without notice to you, deactivate or delete your account and all related information and files.
